ILW disputes on the rise

Disputes and wording issues over industry loss warranty (ILW) payouts are becoming increasingly common as recent catastrophe losses provide a test of trigger mechanisms, LG Legal partner Antony Woodhouse says.

A number of ILW deals have been the subject of wording disputes recently over whether they should be paying out, Woodhouse said.

ILW contracts often use industry loss estimates from reinsurers such as Swiss Re and Munich Re or loss reporting agencies such as Property Claims Services or Perils.
